New York is the latest of several states (CA, AK, CO, HI, IL, ME, MI, MN, OR, MO, NC and UT) positioned to implement a mandatory state long-term care (LTC) plan, similar to Washington State’s Washington Cares Act (the nation’s first mandatory state long-term care plan).
At this time, it isn’t known whether or not there will be any opt out provision in the states that are considering LTC legislation. However, some states have said that any laws that are passed will be retroactively effective on January 1st of the year in which the law is passed.
It is recommended that anyone working in New York should review options before the rush!
